Quick note before I draft: a full Terms of Service is a legal document, and while I can give you a solid, comprehensive draft, I'd recommend having a Texas-licensed attorney review it before you publish — especially as you scale. That said, here's a complete, Shopify-ready ToS based on everything I know about FTF:

Terms of Service

1. Acceptance of Terms

By accessing or purchasing from forthefrolic.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site. These Terms apply to all visitors, customers, and anyone who accesses or uses our Site.

2. About Us

For the Frolic, LLC is a Texas limited liability company operating an online retail store selling print-on-demand apparel and lifestyle products. We sell exclusively through our Shopify-powered website and do not operate a physical storefront.

3. Products

We reserve the right to modify, discontinue, or limit the availability of any product at any time without notice. All product descriptions, images, and pricing are subject to change. Colors may vary slightly from what appears on your screen due to monitor settings and print-on-demand production variances.

Our products are print-on-demand and manufactured upon order. Because of this, all sales are considered final unless your item arrives damaged or defective (see Section 7).

4. Orders & Payment

By placing an order, you represent that you are at least 18 years of age and authorized to use the payment method provided.

We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, suspected fraud, or product unavailability. If your order is canceled after payment, you will receive a full refund.

Accepted payment methods are processed securely through Shopify Payments. We do not store your credit card information.

5. Pricing & Taxes

All prices are listed in U.S. dollars. Applicable sales tax will be calculated and collected at checkout based on your shipping address and applicable state and local tax laws. Shipping charges, where applicable, are added at checkout.

6. Shipping & Fulfillment

Orders are fulfilled through our print-on-demand production partners and typically ship within [X–X business days] of order placement. Estimated delivery times vary by destination and carrier.

We are not responsible for delays caused by carriers, customs, weather, or other events outside our control. International customers are responsible for any applicable duties, customs fees, or import taxes.

Shipping confirmation and tracking information will be sent to the email address provided at checkout.

7. Returns, Refunds & Exchanges

Because our products are made-to-order, we do not accept returns or exchanges for reasons of fit, change of mind, or customer error (including incorrect size selection).

We will issue a replacement or full refund if your item arrives:

  • Damaged or defective
  • With a printing error
  • Significantly different from what was described

To initiate a claim, contact us at hello@forthefrolic.com within 14 days of delivery with your order number and photos of the issue. We reserve the right to determine eligibility for replacement or refund on a case-by-case basis.

8. SMS Marketing

By opting into our SMS program, you agree to our SMS Terms of Service, which are incorporated into these Terms by reference. Message and data rates may apply. Reply STOP to unsubscribe at any time.

9. Intellectual Property

All content on the Site — including but not limited to logos, graphics, product designs, photography, copy, and brand assets — is the property of For the Frolic, LLC and protected by applicable copyright and trademark laws.

You may not reproduce, distribute, modify, or use any of our content for commercial purposes without our prior written consent.

10. User Conduct

You agree not to use the Site for any unlawful purpose or in a way that could damage, disable, or impair the Site or interfere with other users. Automated data collection, scraping, or unauthorized access to our systems is strictly prohibited.

11. Third-Party Links

Our Site may contain links to third-party websites. These links are provided for convenience only. We are not responsible for the content, accuracy, or practices of any third-party sites and do not endorse them.

12. Disclaimer of Warranties

13. Limitation of Liability

To the fullest extent permitted by law, For the Frolic, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of our products. Our total liability to you for any claim shall not exceed the amount paid for the order giving rise to the claim.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas.
